DMCA Policy

1. Overview

PresenceSmith Technology LLC respects the intellectual property rights of others and expects KitaKore users to do the same. We keep a notice-and-counter-notice process for copyright complaints that follows the Digital Millennium Copyright Act (17 U.S.C. § 512).

This policy is only for copyright complaints. Other abuse reports go through our Acceptable Use Policy. Intimate images shared without consent are handled through our separate removal request process, not this one.

3. What You Can Report

Copyright owners, or people authorized to act for them, can report material on a KitaKore user page that uses their copyrighted work without permission, such as images, video, text, music or other creative work.

4. How to Submit a Notice

A notice needs to include all of the following:

  1. Your physical or electronic signature.
  2. A description of the copyrighted work you say has been infringed.
  3. A description of the material you say is infringing, and information reasonably sufficient for us to find it. The link to the page is the best way to do this.
  4. Your name, mailing address, telephone number and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right you say has been infringed.

5. What We Do With a Notice

When we receive a notice that substantially meets these requirements, we act expeditiously to remove or disable access to the material where appropriate. We take reasonable steps to tell the user who posted it, and we may share the notice with them, including your contact details.

6. Counter-Notification

If you believe your material was removed because of a mistake or misidentification, you can send us a counter-notice. It needs to include all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed because of a mistake or misidentification.
  4. Your name, address and telephone number.
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located or, if your address is outside the United States, for any judicial district where KitaKore may be found.
  6. A statement that you will accept service of process from the person who sent the original notice, or that person's agent.

We forward a valid counter-notice to the person who sent the original notice. Unless our designated agent receives notice that they have filed a court action to stop the allegedly infringing activity, we may restore the material not less than 10 and not more than 14 business days after we receive the counter-notice.

7. Repeat Infringers

We maintain and reasonably apply a policy of terminating, in appropriate circumstances, the accounts of users who repeatedly infringe copyright.

8. Misrepresentation

Under Section 512(f) of the DMCA, anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees. Only send a notice or counter-notice if you have a good-faith belief in it.
